Auto accidents

Automobile accidents sometimes happen because of substandard repairs, negligent drivers in parking lots, or intoxicated drivers.   I work with experienced experts to gather evidence at the scene of the accident and assess your legal remedies.

Accident investigations help determine who and what is at fault.  The investigator and I will look into such factors as:

  • How or where the accident occurred
  • Weather, road, and lighting conditions
  • Condition of the vehicle(s)

Clients injured in car accidents often come to me with questions.  Some of these questions are in the FAQ section of this site.   You might be interested in the answers to these inquiries:

Trucking accidents

A collision with a 60,000 pound vehicle is likely to have disastrous consequences.  When you have been injured or a loved one has died in a trucking accident, you need an experienced attorney to help you get the compensation you deserve.   Trucking companies are required to comply with Federal Motor Carrier Safety Administration regulations.  I am experienced with these regulations and can determine whether the at-fault truck driver and his employer were in employer in compliance.  The following are issues that arise in trucking cases:

  • Excess weight
  • Poor maintenance
  • Improper loading
  • Traveling too fast for conditions
  • Speeding
  • Passing unsafely
  • Crossing center lines into oncoming traffic
  • Drinking or using drugs
  • Not obeying traffic laws by following too closely or running a light
  • Driving in what is called a "no-zone", blind spots located around the front, back and sides of the truck where the truck driver cannot see vehicles
  • Cutting between a truck and a curb, resulting in a car getting stuck in a "squeeze play" when a truck is swinging wide to negotiate a turn

The trucking company’s accident investigators will be looking closely for evidence that a passenger car is partly to blame for the accident.  Do not make any statements or sign any documents presented to you by insurance claims adjusters.  Speak to an attorney first. My knowledge of interstate commerce laws and experience with investigating accident scenes can prove valuable to you and your case.   I assess the physical, emotional, and financial losses you have had to endure to ensure that you are fully and fairly compensated.

Even when you adhere to the strictest motorcycle safety standards, you may face an accident and injury.  No matter who is to blame for the accident, I can help you obtain the compensation you deserve for the injuries you have sustained.

Dog bites

Legally, dog-owners are liable for injuries that occur after a dog bite—unless they can prove that you trespassed on their property or somehow provoked the dog.  You need a lawyer to help you investigate whether the dog-owner was negligent in protecting you from harm.  My investigators and I research whether:

  • The dog has a dangerous propensity to bite
  • The dog has bitten someone else in the past
  • The fencing, leash, rope, or chain was not secure enough to restrain the dog
  • There are warning signs regarding the presence of the dog
  • The dog-owner regularly muzzles the dog
  • The dog-owner warns people to stay away from the dog
  • The dog-owner allows the dog to run free despite leash laws

Your injuries require medical care and the dog needs to be restrained in order to prevent future harm.  As an attorney, I can help you take action to protect yourself and others from future harm.  Homeowners and renters insurance often cover the costs of medical injuries.  I can help you pursue the legal remedies available to you.

Disability benefits denied

When your insurance disability carrier has denied your claim, you need an experienced lawyer with a thorough knowledge of the law to help you obtain benefits.  You may be entitled to disability benefits from your insurance carrier.

When an insurance carrier denies your claim, the reviewer is required by law to provide you with the following information:

  • the specific reason why your claim was denied
  • the specific provision in the policy which enabled the insurance to deny your claim
  • the information or documentation you need to provide to make the claim valid
  • a detailed account of how to get your claim reviewed once you have the information or documentation
  • disclosure regarding your right to obtain the information the carrier used to review and deny your claim
  • disclosure regarding your right to bring a lawsuit under the Employee Retirement Income Security Act of 1974 (ERISA) when you have exhausted your administrative remedies with the carrier

When you prove that the insurance carrier acted in bad faith and did not honor the terms of the coverage, you may be entitled to compensatory and punitive damages.
